Provision of services on fixed network

For the operator to provide the contracted service, it is essential to ensure a functioning home installation. If, during the service installation, it is determined that the home installation is not correct, the service cannot be implemented. In such a case, you have the right to terminate the contract. However, you are obliged to reimburse the operator for the activation cost of the wholesale service if the service was supposed to be provided through another operator's network.
 
The operator is obliged to implement the requested service within 30 days from the date of signing the contractual documentation or receiving the request when entering into a distance contract. If the service is not implemented within this timeframe, you have the right to terminate the contract without an early termination fee by submitting a termination request to your operator.
 
If you haven't exercised the right to terminate the contract, you are entitled to compensation for the delay in service implementation, amounting to 30.00 euros per day for each commenced day of delay until the service is implemented, calculated for a maximum of 15 days of delay. You can claim compensation by submitting a written complaint to the operator regarding the delay in service implementation, along with a request for compensation.
 
If you receive compensation for the delay in service implementation and the operator fails to implement the service within 45 days from the date of signing the contractual documentation or receiving the request when entering into a distance contract, you also have the right to terminate the contract without an early termination fee by submitting a termination request.
 
It is important to know that the deadline for service provision does not apply if additional work is required at your location, if you are not available at the location, in cases of force majeure, due to actions of third parties, or due to inability to access the infrastructure, provided that the operator has taken all necessary actions for access in a timely manner.
