Amendments to the Programme in A1 Hrvatska User Packages
Changing the programme content does not necessarily give users the right to terminate the subscriber’s contract, but users who believe they are damaged can always object.
A1 abolishes part of the programmes included in the basic package of TV services and other packages of TV services. Instead of these A1 programmes, A1 includes replacement programmes under the same package fee the users who have been are subscribed to.
In terms of use of the A1 TV service, which are an integral part of the subscriber’s contract, it is stipulated that A1 may modify the programme schedule, inter alia, by adding or exempting individual programmes from the package eor by replacing certain programmes from the package with new ones, or by ceasing to distribute individual programmes that it distributes in package or individually, or by starting to distribute new programmes, and that users should be informed in advance about the amendment. Therefore, this change in the programme content does not necessarily give users the right to terminate the subscription contract, because the change in the programme content is specific and as such does not affect all users equally, especially because the operator will also offer substitute content, In accordance with the Electronic Communications Act, HAKOM points out that beneficiaries, can object to changes, where, on a case-by-case basis, it will be considered whether the mentioned change for a particular beneficiary constitutes a significant change to a particular package of programmes distributed to the beneficiary.
