HAKOM: The IP interconnection Terms Defined, and the Deregulation of Broadband Retail Market Suggested

HAKOM passed the decision on the IP interconnection conditions thus placing Croatia among the small number of EU countries that have IP interconnection rules between operators.

Zagreb, 5 June 2015- HAKOM passed a decision on the IP interconnection conditions placing Croatia among the small number of EU countries that have IP interconnection rules between operators. These conditions will ensure that all the operators’ users have a guaranteed interoperability once their operators switch to IP. Since this is a new and very important issue, the above-mentioned decision is the result of several workshops organized by HAKOM in 2014 and 2015 in order to take into account, as much as possible all the operators’ views. The decision on IP interconnection will be updated in accordance with the market requirements, and each time, when updating the document HAKOM will carry out the previous practice of organizing workshops among the operators and passing a decision by taking into consideration, as much as possible, the operators’ opinion.

Furthermore HAKOM adopted draft decisions concerning market analysis of broadband access, for the purpose of notifying to the European Commission. HAKOM proposes that the relevant Broadband retail market and TV programme transmission market should not be the subject to ex ante regulation and that specific regulatory requirements for Hrvatski Telekom, Iskon and Optima should be abolished.  At the same time, HAKOM has determined that HT, as well as companies under its control (Iskon and Optima), still have an obligation to submit to the regulator the retail prices of the broadband internet access and IPTV services, either individually or in a package with other services .In this way HAKOM can check whether they can pass or not the margin squeeze test.
In case the initial decision is confirmed by the European Commission , HT, Iskon and Optima will no longer have number and duration of promotional offers per year
However, through the retail prices these operators have to ensure the reimbursement of the total costs of the promotional advantages.
