Market analysis

In order to estimate the efficiency of market competition HAKOM conducts market analysis. The analysis procedure consists of identifying relevant markets and assessing the existence of one or more operators with the significant market power on the market susceptible to ex ante regulation. HAKOM imposes regulatory obligations on operators with the significant market power if it establishes that market competition is not efficient on the analysed market and withdraws them when the opposite is established.

HAKOM has applied the three-criteria test and/or market analysis procedure:

Retail level

Fixed network

  • Access to the public telephone network at a fixed location for residential and non-residential customers
  • Publicly available local and/or national telephone services provided at a fixed location for residential customers
  • Publicly available international telephone services provided at a fixed location for residential customers
  • Publicly available local and/or national telephone services provided at a fixed location for non-residential customers
  • Publicly available international telephone services provided at a fixed location for non-residential customers
Broadband
  • Retail broadband access
Mobile network
  • Publicly available telephone services in mobile networks

Wholesale level

Fixed interconnection markets
  • Call origination on the public telephone network provided at a fixed location
  • Call termination on individual public telephone networks provided at a fixed location
  • Transit services in the fixed public telephone network
Broadband access markets
  • Wholesale (physical) network infrastructure access (including shared or fully unbundled access) at a fixed location
  • Wholesale broadband access
Leased lines markets
  • Wholesale terminating segments of leased lines, irrespective of the technology used to provide leased or dedicated capacity
  • Wholesale trunk segments of leased lines 
Mobile interconnection markets
  • Access and call origination on public mobile telephone networks
  • Voice call termination on individual mobile networks
  • SMS termination on individual mobile networks
