Prevention and Sanctioning of an Unauthorized Access to Cable Ducts
The infrastructure operator having information that its electronic communications infrastructure is being accessed without a signed lease agreement or without authorisation, can notify HAKOM in writing (by facsimile, letter or e-mail) and ask for expert supervision, after which HAKOM can initiate appropriate proceedings.
Upon intervention, the expert supervisor shall propose to the Council to make a decision, resolution or a conclusion or initiate a misdemeanour procedure.
Furthermore, in accordance with the established facts and breaches of the Electronic Communications Act, the Council of HAKOM can impose penalties.
