Digital Services Act

The Digital Services Act is a comprehensive set of rules governing the responsibilities of providers of digital services and is directly applicable in all Member States.
 
The objective of the Digital Services Act is to contribute to a safe, predictable and trustworthy online environment, while safeguarding the fundamental rights of recipients of the service (users) and ensuring proportionate obligations for providers of intermediary services, depending on the type, size and nature of the service provided. 

Scope of Application 

The Digital Services Act applies to providers of intermediary services irrespective of their place of establishment, provided that they have users within the European Union. A provider shall, in particular, be considered to have users within the EU where it is established in the EU or where its service is directed at users within the EU.
 
The mere technical accessibility of a service within the EU shall not, in itself, be sufficient to establish that the service is directed at users within the EU. The assessment shall be based on the overall circumstances indicating that the service is directed at the EU market.
 
When determining whether a service is directed at users within the EU, objective factors shall be taken into account, and the assessment shall be carried out on a case-by-case basis.
 
The Digital Services Act applies to services offered to users who are established or located within the European Union. Similarly, the mere fact that a person has permanent residence in the Republic of Croatia shall not, in itself, be decisive. Where a person actually resides and uses services outside the European Union, that person will generally be regarded as being located outside the European Union and, consequently, the Digital Services Act will generally not apply.
