Mutual Assistance, Administrative Cooperation, and Exchange of Information Among Member States (ICSMS)

Correct application of EU legislation depends on seamless administrative cooperation to ensure uniform and effective enforcement of EU law across all member states. Although technical harmonization has established a single market where products move freely across national borders, market monitoring is carried out on a national basis. Therefore, mechanisms for administrative cooperation between national market monitoring authorities are crucial to enhance oversight effectiveness, reduce the impact of varying monitoring practices, and minimize overlapping national surveillance activities. One such IT tool facilitating comprehensive communication among all market monitoring authorities is ICSMS (Information and Communication System for Market Monitoring).

ICSMS (Internal Market Consumer Protection and Enforcement Network System) is a system through which EU Member States exchange information about measures and activities related to market surveillance of products they monitor under their authority. It enables the rapid and effective exchange of information about non-compliant products (including test results, product identification data, photographs, information about economic operators, risk assessments, information about accidents, and details about actions taken by market surveillance authorities, among the competent authorities. ICSMS is not limited to non-compliant products; it also provides information about all products inspected by the competent authorities, even if the inspection results do not indicate any non-compliance.

ICSMS consists of an internal component (accessible only to market surveillance authorities) and a public component intended for consumers, users, and manufacturers. The information visible to the public includes only data related to products and their non-compliance, but does not include internal documents (such as information exchanged between the competent authority and the importer/manufacturer).
